Back to RegistrationInformation Accuracy: The Client confirms that the personal, address and service-requirement information submitted is accurate to the best of the Client's knowledge.
Placement Facilitator / No Agency Employment Link: SBA Home Care acts as a professional placement, matching and agreed administrative/disbursement facilitator. The Agency connects Clients with independent Candidates and does not, merely by introducing or administratively supporting a placement, become the Candidate's day-to-day employer or clinical supervisor.
Primary Employer / Engaging Party: As between the Client and SBA Home Care for the placement relationship, and subject to applicable law, the Client is the Primary Employer / primary engaging party for the Candidate's day-to-day work at the Client's premises. The Client is responsible for daily work instructions, workplace conditions, safety, rest and ordinary day-to-day supervision. This clause does not override any statutory classification or obligation imposed by applicable law.
Final Selection: SBA Home Care may shortlist Candidate profiles from information available to the Agency, but the Client makes the final selection and is responsible for deciding whether the selected Candidate is suitable for the household, patient and agreed duty requirements.
Candidate Availability and Continuity: Placement and uninterrupted continuity are not guaranteed. A Candidate may decline, discontinue or become unavailable for personal, medical, family, relocation or emergency reasons outside the Agency's reasonable control.
Replacement Assistance: If a replacement is required, SBA Home Care will make reasonable matching efforts subject to suitable Candidate availability. The Client remains free to arrange an alternative Candidate from another lawful source if immediate deployment is required.
Candidate Dossier and BGV Provider Disclosure: Where available and appropriate, the Agency may provide controlled access to Candidate identification copies, photograph and background-verification information. SBA Home Care currently facilitates applicable third-party background verification through AuthBridge Research Services Private Limited, an independent private background-verification provider.
Verification Disclaimer: Third-party identity, address, background or crime-record verification is provided according to the checks, sources and information returned by the relevant provider. The Agency does not guarantee the absolute accuracy or completeness of third-party data and no BGV can guarantee a Candidate's future conduct, integrity or behaviour.
Police Intimation / Verification: For household and workplace safety, the Client is advised to complete any applicable local police intimation or domestic-help verification process. Where lawfully available, the Agency may provide necessary Candidate identification records for that purpose.
Confidential Candidate Data: Candidate identity documents, photographs, BGV reports and other personal information received through the Agency must be kept confidential and used only for the relevant placement, verification or lawful police/law-enforcement purpose. The Client must not publish or circulate such records on social media or to unrelated third parties.
Security and Valuables: The Client remains responsible for reasonable household security and for safeguarding cash, jewellery, keys, valuables, documents and other property. The Agency is not a guarantor of any Candidate's future conduct or integrity.
Worker Welfare and Workplace Safety: The Client agrees to provide a safe, humane and lawful working environment, including appropriate rest, food and workplace conditions where applicable. The Agency may suspend or withdraw placement support where substantiated abuse, harassment, violence or unsafe conditions are reported.
Duty Scope and Material Changes: Duty timing, tasks, location, remuneration or wage arrangement, weekly off and other placement conditions must be agreed for the relevant duty. Material changes should be communicated because they may affect Candidate willingness, suitability, availability or commercial terms.
Billing, Online Payment and Administrative Disbursement: Agency invoices, commission/charges, due dates and payment obligations follow the written commercial arrangement for the relevant service period. Where online payment is required for audit records, the Client should use the official payment channel. Any wage collection or disbursement handled by the Agency as an administrative convenience does not by itself create an employer-employee or clinical-supervision relationship between the Agency and Candidate.
Delay or Non-payment: Material delay or non-payment of valid Agency charges may result in suspension of Agency placement, replacement or administrative support, subject to the applicable written arrangement and law.
Liability, Incident Reporting and Law-Enforcement Cooperation: To the extent permitted by applicable law and subject to the final written service arrangement, the Agency is not a guarantor against theft, damage, misconduct or other future individual acts of an independently placed Candidate merely because the Candidate was introduced through the Agency. If a serious allegation such as theft or violence arises, the Client may approach the appropriate law-enforcement authority and the Agency will reasonably cooperate with records lawfully available to it, subject to privacy and disclosure requirements. Nothing in these Terms excludes liability that cannot lawfully be excluded or liability arising from the Agency's own proven fraud or wilful misconduct.
Disputes, Governing Law and Service Communication: Routine disputes concerning daily tasks, conduct, wages or workplace interaction should primarily be addressed between the Client and Candidate, with the Agency providing reasonable administrative or mediation support where appropriate. The Client agrees that SBA Home Care may contact the Client by phone, SMS, WhatsApp, email or app/web notification for registration, matching, placement, billing, replacement and related service communication. These Terms are governed by applicable Indian law. Subject to any mandatory statutory or consumer jurisdiction, courts at Kolkata shall have jurisdiction.
Digital Consent and Version Record: Selecting the acceptance checkbox and electronically submitting the service requirement constitutes the Client's acceptance of the Terms & Conditions shown for the selected service or services at that time. The accepted Terms & Conditions, applicable version record and acceptance evidence may be retained for legitimate legal and operational purposes. Duty-specific, billing or other written terms may also apply where relevant.
Patient Care Role Scope: For Elder Care, Ayah / Patient Attendant, Male Attendant, GDA / General Duty Assistant and qualified ANM/GNM or other nursing Candidate placement requirements, the agreed duty should be based on the selected Candidate's role, available records and the Client's stated care requirements.
Role Classification: Elder-care attendants, Ayah / Patient Attendants, Male Attendants and GDA / General Duty Assistant Candidates are not represented as licensed nurses or medical practitioners merely because they are placed under a patient-care category. The agreed duty should match the Candidate profile, training and documented competency.
Qualified Nursing Placement: Where the Client requests an ANM, GNM or other qualified nursing Candidate, SBA Home Care may facilitate placement according to the Candidate's stated qualification and, where applicable and available, registration-related records held in the Candidate file. The Client should review the relevant records before final selection.
Medication and Clinical Task Boundary: A non-nursing Candidate may provide reminders or assistance only within the agreed role and according to Client or treating-professional instructions. Nursing procedures, medication administration, wound/catheter-related care, monitoring or other clinical tasks should be assigned only where appropriate to the selected Candidate's documented qualification, registration, training or competency records available for the placement and should follow treating-doctor or authorised medical-professional instructions. No Candidate should independently diagnose, prescribe or alter dosage.
Patient Safety Information: The Client should disclose relevant mobility or transfer needs, infection precautions, allergies, behavioural concerns, equipment, doctor-advised precautions and emergency contacts reasonably required for safe duty planning.
No Agency Clinical Supervision: SBA Home Care does not prescribe treatment, make medical decisions, provide clinical supervision through this placement service or guarantee clinical outcomes. Clinical decisions remain with the Client, patient and treating medical professionals.
Emergency Care: If the patient condition requires urgent medical attention, the Client should contact the treating doctor, hospital or appropriate emergency service rather than relying solely on a placed Candidate.
